Consenting to these Terms is obligatory when you book a charter or utilize our Service. If you are not in agreement with any portion of the terms herein, you are barred from using the Service.
2. Service Overview
At OpenResourceCenter, we offer an elite yacht charter experience, which includes a variety of options such as:
- Full-day yacht hire
- Evening pleasure cruises
- Business getaway packages
- Exclusive gatherings
- Extended yacht charters
These services are provided based on their current availability and are also contingent upon favorable weather conditions. We retain the prerogative to adapt or cease our offerings without notice at any given time.
3. Booking and Reservations
3.1 Booking Process
For charter reservation, the following requirements must be met:
- Attainment of at least 18 years old
- Submission of precise and thorough details
- Remittance of the requisite initial payment as indicated in the booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
Confirmation of your reservation occurs only after we have received your payment and provided you with a written confirmation. Service may be declined at our discretion.
3.3 Availability
Charter availability is contingent upon the vessel's accessibility and favorable meteorological conditions. Efforts will be made to comply with your requested scheduling preferences.
4. Terms of Payment
4.1 Cost Details
Quoted prices are in € and tax-inclusive unless indicated otherwise. Please be aware that prices can vary without prior notification.
4.2 Schedule of Payments
- Initial Payment: 50% of the aggregate cost of the charter is required at the time of reservation.
- Final Payment: The remaining balance must be paid no later than 48 hours before the departure of the charter.
- Incidental Expenses (if applicable): Payable upon the conclusion of the charter.
4.3 Accepted Methods of Payment
We welcome payments through major credit cards, electronic bank transfers, and bank-certified cheques. Our payment processes utilize secure and encrypted systems.
5. Policy on Cancellations and Issuing Refunds
5.1 Cancellations by the Customer
- If cancelled more than 72 hours prior to departure: A complete refund minus any service charges
- Cancellations made between 24 to 72 hours before departure: Half of the payment will be refunded
- Cancellation less than 24 hours before departure: No repayment will be provided
5.2 Cancellations due to Inclement Weather
Should the weather be considered unsafe for sailing by our captain, customers will be presented with options to:
- Move the booking to an alternative available date at no extra cost
- Obtain a full reimbursement if it is not feasible to reschedule
5.3 Mechanical Failures
Should there be a mechanical failure on the vessel allocated for your excursion, efforts will be made to arrange an alternate vessel. In the absence of a suitable replacement, a complete refund will be granted.
6. Safety and Conduct
6.1 Safety Requirements
All travelers must:
- Adhere to all directives from the crew
- Use safety gear when it's necessary
- Declare any health conditions that could impact their well-being
- Stay within authorized sections of the ship
6.2 Prohibited Items
The following items are forbidden to bring aboard:
- Glass bottles
- Banned substances
- Weapons or firearms
- Unreasonable amounts of alcohol
- Animals (except with prior permission)
6.3 Conduct
Travelers are expected to behave in a considerate fashion. The company retains the authority to end a trip prematurely with no reimbursement if a traveler's behavior is deemed dangerous or interferes with the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
Our financial responsibility is restricted to the amount you have paid for our charter services. We are not liable for the following:
- Injuries sustained by passengers due to their own misconduct
- Any lost or damaged personal belongings
- Incidental, special, or punitive damages
- Delays arising from inclement weather or events that are out of our control
7.2 Insurance Coverage
We ensure to keep our fleet and operations protected under extensive marine insurance. It remains the passengers' duty to obtain their personal travel and belongings insurance.
7.3 Assumption of Risk
By choosing to use our charter services, you accept that being at sea has inherent dangers and voluntarily accept the risk, agreeing to be accountable for ensuring your personal safety and security.
8. Modifications and Itinerary Changes
Our organization maintains the authority to alter travel plans, pathways, and timetables due to factors like weather scenarios, safety concerns, or essential operational demands. We will aim to offer alternatives of equivalent value whenever changes are necessary.
9. Force Majeure
Our company shall not be held accountable for any hold-ups, terminations, or journey alterations that occur due to events beyond our jurisdiction, particularly but not limited to the following occurrences:
- Extreme meteorological phenomena
- Catastrophes caused by nature
- Edicts issued by authorities
- Shutdowns of docking facilities
- Technical breakdowns
10. Privacy and Data Protection
We manage your personal data according to our Privacy Policy. When you make use of our offerings, you are agreeing to our collection and processing of your information as our Privacy Policy outlines.
11. Intellectual Property
The materials on our platform, such as texts, visuals, trademarks, and photographs, are under copyright and trademark protection. Reproducing, circulating, or modifying these works without our explicit consent is prohibited.
12. Governing Law
The conditions stated here are subject to the laws of France. Legal proceedings should be conducted in the courts of Cannes, France.
13. Changes to Terms
